Information on Section 504 

Section 504 Services are designed to provide a system of identifying eligible students with disabilities as defined under Section 504 of the Rehabilitation Act. Once identified, these students are ensured access to a Free and Appropriate Public Education (FAPE) by providing accommodations that allow equal access to the curriculum in the general education setting. The statute is intended to prevent intentional or unintentional discrimination against persons with disabilities, persons who are believed to have disabilities, or family members of persons with disabilities.

 Section 504 of the Rehabilitation Act of 1973, as amended (2009) and further clarified in 2010, prohibits discrimination against persons with disabilities in all programs and activities that receive federal financial assistance. An eligible student is one who:

  • has a physical or mental impairment which substantially limits one or more major life activities;
  • has a record or history of such impairment;
  • is regarded as having such an impairment. 

While many students who receive 504 status and services are Dyslexic or have Attention Deficit/Hyperactivity Disorder (ADHD), services are not limited to only these areas of disability. Any student with a disability that substantially limits one or more life activities may be considered for 504 services.

Nondiscrimination Statement

In its efforts to promote nondiscrimination and as required by law, ECISD does not discriminate  on the basis of race, religion, color, national origin, gender, sex, disability, age, or any other  basis prohibited by law, in providing education services, activities, and programs, including CTE programs, and provides equal access to the Boy Scouts and other designated youth groups. In accordance with Title IX, the district does not and is required not to discriminate on the basis  of sex in its educational programs or activities. The requirement not to discriminate extends to  admission and employment. Inquiries about the application of Title IX may be referred to the district’s Title IX Coordinator  (see below), to the Assistant Secretary for Civil Rights of the Department of Education, or both. Other federal laws that prohibit discrimination include Title VI, Section 504, the Age Discrimination Act, the Boy Scouts Act, and Title II.

Complaints alleging discrimination or harassment based on race, color, religion, sex, gender, national origin, age, or disability shall be submitted in accordance with FFH. (LOCAL)

A board shall provide for procedures to consider complaints that a parent’s right has been denied. Education Code 26.001(d)

A board shall adopt a grievance procedure under which the board shall address each complaint that it receives concerning a violation of a right guaranteed by Education Code Chapter 26 (Parental Rights).

The board is not required by the provision above or Education Code 11.1511(b)(13) (requiring adoption of a process to hear complaints) to address a complaint concerning a student’s participation in an extracurricular activity that does not involve a violation of a right guaranteed by Education Code Chapter 26. This provision does not affect a claim brought by a parent under the Individuals with Disabilities Education Act (20 U.S.C. Section 1400 et seq.) or a successor federal statute addressing special education services for a child with a disability. (LEGAL)
